An open response to self medicating with cannabis in the UK

We seen the following posted as a reply on a Facebook post recently where an individual was being taken to court for a small home grow.  We thought this was a great post which sums up the (legal) struggle some people are facing when trying to self medicate to save their own life or quality of life.

 

We provide this post purely as educational and for reference but if anyone is in a similar situation please ensure you seek proper and full legal representation.  Point 2 is huge!

 

1. To whom it may concern, this is a submission of evidence in my defence. I cannot plead guilty to breaking a law that will harm my health were I to abide by it. My actions caused no harm to others and, as such, prosecuting me for my actions would not be in the public interest. I acknowledge I lacked the relevant licence that are available to commercial entities, but I refuse to accept all concept of guilt. For how can one be considered guilty for trying to save one’s life?

 

2. This document is my declaration of my non-criminal intent. My actions are in pursuit of my health and well-being for managing a terminal illness and are made in light of the current confused legal status of the use of cannabis for medical purposes, which is currently available on Private Prescription to the few that can afford it, yet unavailable and denied to the poor, who are condemned to suffer or risk criminalisation due to the NHS guidelines.

 

3. Therefore, as a law abiding, decent and honest human being not wishing to contribute to the criminal market, I determined to seek autonomy of health, self sufficiency and sustainability by making my own cannabis herbal health remedies, which I know to be suitable, effective and adequate for my illness, as I have determined best for myself.

 

4. This was the most moral and ethical course of action to take. Due to the existing economically discriminatory legal situation, the inherent risks of the unlicensed, uncontrolled cannabis market, combined with the fact that there is no known, or offered treatment for my condition, my actions offered me the safest route to managing my conditions, thereby extending and achieving a more dignified quality of life.

 

5. I researched independently and I accepted the purported medical ‘risks’ of the path I have chosen, with the knowledge in my heart that I act with no criminal intent and my health and well-being are my sole priority. I was left with little choice than to follow this path.

 

6. Furthermore, In light of the fact that the UN and the WHO have confirmed the absence of Foundation of Evidence for the fraudulent, racist and ideologically motivated Schedule 1 status of cannabis, combined with the considerable UK Political conflict of interests of significant Parliamentarians in the ‘medical cannabis industry’ who also deny democratic discourse, I am compelled to remove all consent to be governed by the Misuse of Drugs Act 1971 and all subsequent amendments, as all Acts invalid from their onset cannot be validated by any subsequent Act.

 

7. My Health has forced me to have to disregard an Act of parliament that harms my health and well-being if I were to abide by it, thereby putting my life at considerable risk.

 

8. I faced deteriorating health, and risk of death due to ill health. However, with my home produced herbal cannabis health remedies, I have reversed my health condition. This contradicts schedule 1 of the drugs act.

 

9. My Doctor and Consultant are aware of my actions.

 

10. GP. Dr. ******. Consultant. Dr. ***** ***** ****

 

11. Cannabis does not meet the criteria for a schedule one or two substance as currently legislated for. Please provide foundation evidence for schedule one and two status, as currently legislated.

 

12. Cannabis is NOT a controlled substance in the UK, which many MP’s and PCC’s have commented on multiple times recently. Please provide foundation evidence for proof of controlled status.

 

13. Please drop all charges against me or present your foundation of evidence for my misuse of cannabis as a medicinal user, when various companies have patents relating to its medical efficacy.

 

14. Consequently, I request that you provide the above requested evidence, or drop all charges raised against me, as it is not in the public interest to prosecute me for my actions.

 

15. I also move to reinvoke the defence of medical necessity, which was clarified and defined by a high Court imposing the decision on the lower crown court that the defence of medical necessity cannot be used as a defence to ‘alleviate pain or suffering’ but can be used as a defence in a prosecution if the offence was committed ‘to avoid serious injury or death’ in which case that matter will be put to the jury.

 

16. So I refuse all guilt and will seek judgement by a jury of my peers as my actions were in the pursuit of avoiding serious injury or death due to my health condition and this law is based on lies, is harmful to health, so needs must be broken until Democratic process final beats conflicting political interests.

 

Summary

 

We feel that this is well written, challenges the ridiculous laws around cannabis use for medical reasons and clearly conveys that self medicating should not be treated as a criminal activity, particularly when in the UK we are now in a place where the rich have options to take advantage of this medicine yet the poor do not.

 

Change must happen!

  1. Two words that should never belong together is a part of my everyday life. Those words? Illegally. Healed. If I had not been the rebel I am and obeyed the law, I would have died long ago. Not from my condition, but from the Pharmaceutical Industry’s petrochemical-based, snake oil remedies’ side effects!

    Never, ever use the law as your moral compass – Slavery was “legal,” Apartheid was “legal,” Prohibition is “legal.”

  2. Great points but, a more persuasive argument would be to simplify and visualize. Sorry I could only read up to number 2.
    Remeber when we had a totally negative view of weed the image was Bad Teeth losers on Jeremy Kyle. That is the mind you have to change.
    Describe your suffering, no kind person could argue against it.
